What happens if I request an ADA (American with Disabilities Act) accomodation and Delta denies it?

Delta can deny your request for an accomodation if it creates an undue hardship on the business. Undue hardship means that the accomodation would be too difficult or too expensive to provide, taking into consideration the employer’s size, financial resources and the needs of the business.

Our contract doesn’t address ADA accomodations, but it does prohibit the discrimination on the basis of physical handicap or mental condition. This means that you may not necessarily have a “grievance” to file, but if you believe you are suffering discipline (quality/production/attendance) as a result of your need for accomodation, you can pursue a complaint with the California Department of Fair Employment and Housing. You can learn more about CAL FEHA and the complaint process at www.dfeh.ca.gov.

ADA Leaves can be complicated, do no not hesitate to ask questions of Human Resources and check the information with the Local Union who can assist with legal questions and attorney referrals if necessary.


I have an issue that isn’t related to the Union contract or my employment. Can the Union give me a lawyer?

If the matter isn’t related to your employment status or a contractual grievance, then you will need to retain your own private counsel. The Union can assist you with this by referring you to a trusted law firm that can review your case and advise you on your options. Contact your business agent with questions.
